DOT Affirms Nov. 1, 2008 Date for Direct Observation of All Return-to-Duty and Follow-Up Testing

On October 22, 2008 DOT issued a Federal Register notice affirming the November 1, 2008 implementation date for conducting all Return-to-Duty and Follow-up testing using Direct Observation procedures.

DOT had delayed implementation of this rule in order to allow for public comments. The Federal Register notice published on Oct. 22, 2008 summarizes the public comments regarding the proposed rule and the Department's responses. Although some commentors opposed the proposed rule requiring all Return-to-Duty and Follow-up testing be conducted using Direct Observation procedures, DOT remains convinced of the benefits of implementing the rule.
